Ports Denarau Marina Limited 20 year exclusive license cancelled without warning or compensation. This license was issued in return for extensive dredging and development of what was then a swamp. No legal challenge allowed. Announced today but came into force yesterday.

The Denarau (Nadi River) Development Decree 2011 has been approved by Cabinet and published in the Government Gazette.
 
The Decree will come into force as law from February 9, 2011.

Since 2000, access to and the use of the channel was exclusively granted to Ports Denarau Marina Limited (“PDML”) by way of a special licence issued by the Director of Lands over this State foreshore land. The special licence was issued for a period of 20 years with effect from January 1999, to an area of approximately 26 hectares at an annual rental of only $400.00.
The Decree vests absolutely in the Director of Lands any existing interest in the channel.
 
Any licence or any other instrument of title issued to any person or body in relation to the channel is cancelled.
 
Any person who obstructs or prevents any person from accessing or using the channel, shall be guilty of an offence and liable to a fine and/or imprisonment.

I have been under a lot of stress as Mubarak of the pacific crumbles under the pressure….will bhaini mongoose and his family have to answer the call like mubarak?….to put it simply, they are shitting themselves….at least daddy only peed his pants…..

  3. Why the hell would the state offer exclusive rights to the channel for just $400 a year. And this was since 2000.

    Can someone do a company search to find who the shareholders and directors of Port Denarau are?

    This is like another Fiji Water set up. (with only 0.3c per bottle tax).

    Good on the Interim Government for the decree. Foreign investors should realise that Fiji encourages investing but without bribes and corruption.

    Look at the loss of revenue. either someone was really stupid to offer control of the channels for $400/year in 2000 or was bribed to sign contracts for that.

    All this changes would not have been possible without the current government. An extra $20 million a year from Fiji water. Waters around the Marina is public good thing the government got it back.

    If you want Qarase’s government you want corruption, bribery back.

  7. Ruling by decree is lazy government – no negotiation, no recourse and no discussion.

    You can agree one thing with the government but there is nothing to gaurantee that they will honor the agreement.

    No wonder noone wants to invest in Fiji.
