Judge to rule on notice

THE Fiji Court of Appeal will rule on notice on Fiji Labour Party leader Mahendra Chaudhry’s appeal against a High Court ruling refusing to stay his conviction and sentence on exchange control charges.

Chaudhry’s lawyer Anand Singh told the Court of Appeal yesterday that High Court Justice Paul Madigan was wrong in not allowing the stay application.

He said with Mr Chaudhry’s substantive appeal due to be heard, it would be only fair to his client that a stay on the sentence and conviction be granted as it violated Chaudhry’s fundamental right to contest the September general election.

State prosecutor Mosese Korovou said the grounds of appeal submitted by Mr Singh had no merit and most of the matters of law argued by Mr Singh had been decided on the agreed facts.

Justice William Calanchini said he would give his ruling on notice.

Chaudhry was sentenced to pay a fine of $2million for keeping $A1.5m ($F2.54m) in banks in Australia without the approval of the Governor of the Reserve of Fiji.

The conviction renders him ineligible to contest the election.

  2. You don’t have a “fundamental right” to contest an election if you have a criminal conviction. More so for a conviction that goes to blatant dishonesty. Chaudhry has held positions of trust. This charge is a breach of trust and clearly shows that he is not fit to hold ANY office.

    It is a shame that the illegal PM and AG have not yet been convicted for the offences they have committed.

  3. It is a known fact that Calanchini does not act without seeking orders from the AG. The AG has probably given a draft judgment to him already.
