UPP President Mick Beddoes said today the announcement last night by the President and Regime leader was not only a monumental reversal of the constitutional process currently underway, but their announced plans to effectively ‘alter’ the draft constitution ahead of it being debated in the CA was effectively Coup 5

Beddoes said the President’s ‘role’ in this process as contained in the Regimes Decree 58 of 2012 Sec 6 is quote ‘The President shall, upon receipt of the draft Constitution and Explanatory Report from the Commission, refer the draft and Explanatory Report to the Assembly for debate and adoption’ unquote. That’s it, that’s what Decree 58 says he’s to do with the draft he was handed? There are no provisions for him to do otherwise!

By commenting as he did and effectively ‘trashing’ the work of the Commission which he as President accented to by decree, the President went beyond his authority and in so doing displayed his utter contempt for the people of Fiji and their wishes & aspirations which they spelt out in the many thousands of submissions they made to the Commission during the Constitutional Submission process.

Beddoes said he hoped that the citizens of Fiji, especially those who were ‘partially blind’ to what has been going will now see from last night’s performance the extent of the insincerity and contempt that the President and the Regime leader have for the people through their joint condemnation of the original draft which contains much of the hopes and aspirations of the people.

Beddoes said, the announcement last night was not a surprise, because the Regime started its move with the introduction of Decree 64 on October 31st which effectively removed the people from the process and now their joint announcement last night was made to pave the way for ‘wholesale’ changes [as I have previously commented on] to the draft before it reaches the Constituent Assembly for debate.

This is where the military’s demands and other changes will find their way onto the new draft for the CA to debate. No doubt the emergence of a ‘Presidential system’ of governance to secure the Regime’s rule in Fiji, could even find its way on to the draft in some form.

  1. FIJI’S military government has announced it will dump a draft constitution prepared by an academic panel and prepare its own version, a move New Zealand has labelled a “backward step” for the Pacific nation.

    Military leaders in the coup-plagued island state commissioned a panel led by Kenyan academic Yash Ghai to draw up a constitution last year but took issue with some recommendations.

    President Ratu Epeli Nailatikau said Ghai’s blueprint risked reigniting racial tensions in Fiji, where divisions exist between the indigenous population and ethnic Indians brought to the country in the colonial era.

    He said it also threatened to undo reforms introduced by Prime Minister Voreqe Bainimarama, who seized power in a 2006 coup and has pledged to hold elections in 2014 after the new constitution has been adopted.

    “The Ghai draft can lead to financial and economic catastrophe and ruin,” Nailatikau said in a nationally televised address on Thursday night.

    Leaked copies of the draft indicate Ghai wanted the military, a key player in the four coups since 1987, to stay out of politics after the 2014 elections.

    He also called for a transitional government to take over ahead of the 2014 vote, meaning Bainimarama would have to cede power.

    New Zealand Foreign Minister Murray McCully said the government had effectively “trashed” the work of Ghai’s constitutional commission, which completed its draft after receiving more than 7000 public submissions.

    He said the international community would be watching closely to ensure the new constitution allowed for free and fair elections, rather than providing a blueprint for the military’s version of democracy.

    “This is not flash. It’s a backward step of some proportions,” McCully told Radio New Zealand.

    “But it’s been the history of this whole process. This is not going to be a simple straight line towards elections and international credibility. There are always going to be steps forward and steps back.”

    He added that the move by the military to draw up its own draft constitution was “rather larger a step back than any of us feel comfortable with, but it’s what we’ve got to work with”.

    The new draft constitution is expected to be completed by the end of the month.

  4. CCF stands by Ghai draft constitution

    The Citizens Constitutional Forum stands by and supports the draft constitution by the State appointed Constitution Commission.

    This is the comment from CCF CEO Akuila Yabaki following the announcement made yesterday.
    According to Yabaki the draft constitution is consistent with good constitution making principles and reflects the voice of the people of Fiji

    According to Yabaki all concerns raised yesterday are items the Constituent Assembly should be tasked to discuss and determine for themselves in consultations with the citizens.
    Yabaki therefore urges the Government to rescind its decision and allow the constitution making process to take its course as set out in Decree 58.

    Another ‘coup within a coup’ aye? A leaf straight out of Bainimarama’s 2000 Coup manual. And we were going to listen to Prof Ghai and let them off the hook AGAIN if they merely uttered pretty words? Utter lunacy.

    The regime is in a bit of a bind. It will be a hard sell right now to gloss over the insincerity of their intentions and the empty rhetoric on ‘democracy’ – not even Canberra can sell this epic constitutional phuk up now and the Grubby QORVIS spinmeisters talents do not extend to magic.

  9. The well respected professor has gone insane trying to please the old order of old fart politicians, NGO Leaders, church groups and corrupt chiefs in beautyful Fiji Islands.

    We dont need the Prof Ghai’s Draft constitution to be implemented as there are two new circus added to the Draft Constitution.

    It aims to bring back the old corrupt politicians and conman and non performing politicians and “yes men” to highly corrupt party leaders – the old order of losers who had instigated military coups of the past after being thrashed out at a fair and democratic elections?

    Who in Fiji wants a 71 seat parliament – the old losers/politicians and Ghai – not the taxpayers of Fiji who are going to foot the bill.

    A parliament of 71 members is a big a number for a small country like fiji when funds could be better utilised for building infrastructure? The sad thing is that half of these members were a waste of space and non performing.

    Who in fiji wants another circus of 144 unelected members constitution assembly – Ghai and losers – not the taxpayers of fiji who will foot the bill, my dear professor?

    Who in Fiji wants the old corrupt GREAT COUNCIL OF CORRUPT- Ghai and Losers – magaitinamu chiefs – not ordinary fijians whose lease monies have been sucked by these sharks (chiefs) since ages.

    Hence; there is an urgent need to review the Ghai Draft and make appropriate changes to suit the fijian scenario.

    I will not totally propose to dump the Ghai Draft but take the good things out of it and make appropriate changes.

Yes we read you…….Its plain omni-shambles…..the junta and its schemed constitutional review that was never really meant to involve the people because it was all about helping them out of the crime they still stand accountable for. Justice fortunately always has the final say and one day it will certainly fall upon the thugs who have wronged the people.
