A message from Justice William Marshall

The fact is that the Attorney General completed the removal of judicial independence in Fiji in April 2012. The judges no longer do their duty and do not serve the people of Fiji. They do what they believe the Attorney General would wish them to do. In many cases this is specifically explained to them by or on behalf of the Attorney General.

Some judges have been doing this since 2010 since they are used to the executive telling the judges what to do. Others have started doing it in April 2012 because they know that if they do not do what the Attorney General desires they will be dismisssed. A key “tipping point” in this process was when it became known on or about 12th April 2012 that my contract would not be renewed.

So I petitioned the Prime Minister and the Military Council in a Petition dated 21st June 2012 for the dismissal of the Attorney General.
The Petition and the supporting documents disclose all the relevant facts. They can be accessed, perused or downloaded in whole and in part from this website. My duty is to appraise informed opinion in Fiji of these facts which prove that Fijians are being cheated and are being deprived of justice in their law suits both criminal and civil.

Why a website? I have no choice. The Attorney General runs censorship and untrue propaganda. At the end of my contract I wrote an uncontroversial letter to the Fiji Times on 15th July 2012. I said on behalf of myself and my wife, that we wished to thank the people of Fiji for their welcome and their support to us. It did not appear in the Fiji Times.

  1. Justice W.Marshall very comprehensive petition,thank you very much. This clears the way for Mr Chaudhry to boycott the charges framed against him by the illegal choor Khaiyum until such time democracy has come back and independent judiciary is setup.

    1.judiciary is corrupt
    2.khaiyum is checking and approving judgments.
    3.qarase was jailed by khaiyum
    4.khaiyum caused bainimara to cancel march 2009 election originally planned by the military
    5.khaiyum advised that the 1997 constitution be abrogated
    6.khaiyum advised to outsource the ministerial salaries to nur bano and fixed his and pm’s salary$1m
    7.khaiyum wants the 2014 elections cancelled and new date set for 2020.
    8 now we know it was khaiyum that approved the $200.000 leave pay to bainimarama to introduce him to corruption.

    If the above is true than why did you accept the position as an Appeals Court Judge knowing the current status of Fiji?

    Don’t you think you’re an hypocrite?

    So the evil regime allowed you to complete your contract without hindrance?

    The Fiji Times is not obligated to print any crap they choose not to print after all its their prerogative don’t you think?

    The question is did you execute your duty to the best of your ability without prejudice?

    Did you, when sitting in judgement were ever asked by the AG to compromise or lessen the severity of any given crimes and thereby bemiring the Judicial process?

  6. What baffles me is his naivity or possibly stupidity in thinking that Bainivuaka is somehow above all this and can be trusted to do the right thing with regards to Aiyarse! Considering that he came to Fiji in 2009 “well read” and “well briefed” …by whom??? And then goes on to congratulate Bainivuaka on removing Qarase’s “corrupt, racist..” government when he wasn’t even here and which we haven’t seen a conviction to date…well that just tells me Billo that you got played big time and you got what you deserved by jumping in to bed with this band of thieving coupsters. When you lie down with dogs, you get up with fleas…so have fun picking off those fleas, but thanks for the insight into Aiyarse, something we already knew but good to see it come from you.

    “SACK AIYARSE, HE IS BAD MAN”
    Bai won’t get past the first page of your petition…and the military council wouldn’t make it to page 2.

  8. @Ratu Sai, the bainimagana regime lies to the world about the wonderful work it is doing in Fiji, this cons expats into thinking they are truly coming to Fiji to help the nation. Then they arrive and see the corruption, lies and dictatorship firsthand, but its too late then. Khaiyum is a corrupt dog and needs his mothers voodoo to sustain him in his manipulation of that idiot bainimagana.

    That “old white boy” can write a court judgement, with actual legal thinking. You can barely string a sentence together.

    But don’t worry, lack of legal experience hasn’t stopped Aiyaz from being paid.

    Maybe you can speak to Aiyaz and be a judge too?
